1. Acceptance of Terms

By accessing the website at mansfieldconcretecompany.com or by requesting, scheduling, or receiving services from Mansfield Concrete, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, do not use this website or request services from us. These terms apply to all visitors, customers, and others who access or use our website or engage our services.

2. Description of Services

Mansfield Concrete is a concrete contractor based in Mansfield, OH. We provide residential and commercial concrete services including, but not limited to, driveway installation, patio construction, stamped concrete, sidewalk building, foundation work, slab installation, retaining walls, pool decks, steps, concrete cutting, and related flatwork. Services are performed by our crews or approved subcontractors and are subject to the terms set out in a written agreement or estimate provided before work begins.

3. Estimates and Pricing

Estimates provided by Mansfield Concrete are based on information available at the time of the visit and are valid for 30 days from the date issued unless otherwise stated in writing. An estimate is not a guaranteed final price. Final pricing may vary from the estimate if:

• Site conditions differ materially from those observed during the estimate visit.
• The scope of work changes at the customer's request after the estimate is issued.
• Unforeseen conditions are discovered once work has begun, such as buried obstructions, unstable soil, or existing damage not visible during inspection.
• Material costs change significantly between the estimate date and the project start date.

Any changes to scope or pricing will be discussed with you and require your agreement before additional work is performed. We do not perform work above the estimated amount without your authorization.

4. Scheduling and Cancellation

Project start dates are scheduled after a written agreement or accepted estimate is in place. Scheduled dates are subject to weather conditions, permit processing, and material availability. We will communicate schedule changes as early as possible.

If you need to cancel or reschedule, please notify us as soon as possible by calling (567) 345-1035 or emailing estimates@mansfieldconcretecompany.com. Cancellations made less than 48 hours before a scheduled start date may be subject to a fee to cover crew mobilization and material costs already incurred. That fee will be specified in your written agreement.

We reserve the right to reschedule or cancel a project if site access, weather, or safety conditions make it impractical or unsafe to proceed.

5. Payment Terms

Payment terms are specified in the written estimate or agreement provided before work begins. In general:

• A deposit may be required before work begins to secure materials and scheduling. The deposit amount will be stated in your written agreement.
• The remaining balance is due upon project completion unless otherwise stated in writing.
• Accepted payment methods will be specified in your agreement.
• Invoices not paid within the period stated in your agreement may be subject to a late fee of 1.5% per month on the outstanding balance, or the maximum rate permitted by Ohio law, whichever is lower.

If payment is not received and collection becomes necessary, you agree to reimburse Mansfield Concrete for reasonable collection costs, including attorney fees, to the extent permitted by applicable law.

6. Permits and Inspections

Where required by local ordinance, Mansfield Concrete will obtain the necessary permits before work begins. Permit fees are typically included in the written estimate. The customer is responsible for ensuring that property boundaries, utility markings, and any HOA or neighborhood restrictions are disclosed to us before the project starts. We are not responsible for delays or added costs caused by permit issues arising from undisclosed restrictions or incorrect property information provided by the customer.

7. Warranty Disclaimers

Mansfield Concrete warrants that work will be performed in a workmanlike manner using materials appropriate for the stated purpose. Any specific warranty terms will be set out in your written agreement.

Concrete is a natural material and minor cracking over time is normal and expected. Warranty coverage does not extend to:

• Cracking or damage caused by freeze-thaw cycles, normal settlement, soil movement, or tree root intrusion.
• Damage caused by improper use, including vehicle loads exceeding the design specification.
• Surface discoloration or variation in color, texture, or sheen that is inherent to the concrete curing process.
• Damage caused by the application of deicing chemicals or road salt within the first year after installation.
• Work performed by others after our project is complete.

Except as stated in your written agreement, all services are provided "as-is" and Mansfield Concrete makes no other warranties, express or implied.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Mansfield Concrete shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising out of or related to services provided or the use of our website.
• Loss of use, loss of profits, or other economic losses resulting from project delays, rescheduling, or unforeseen site conditions.
• Damage to underground utilities, irrigation lines, or other buried infrastructure not disclosed or properly marked before work begins.

Our total liability to you for any claim arising out of a project shall not exceed the total amount paid by you for that specific project.

9. Customer Responsibilities

Before work begins, you agree to:

• Ensure the work area is clear of vehicles, equipment, and personal property.
• Disclose the location of underground utilities, irrigation systems, and any known subsurface conditions.
• Confirm that necessary permits or HOA approvals are not blocked by restrictions you are aware of but have not disclosed.
• Provide reasonable site access for crew and equipment on scheduled work days.

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any legal action arising under these terms shall be brought exclusively in a court of competent jurisdiction located in Richland County, Ohio.

13. Modifications to These Terms

We reserve the right to update or modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Your continued use of our website or services after changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
